Subject: 10560/Code-AppB/Zoning/SetbackRequirements Date: Tue, 24 Apr 1990 11:55:00 -0500 ORDINANCE NO. 10560 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO AMEND THE RZ-1 ZERO LOT LINE RESIDENTIAL ZONE AND THE R-T/Z RESIDENTIAL TOWNHOUSE/ZERO LOT LINE ZONE, RELATIVE TO SETBACK REQUIREMENTS. __________________________ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, the Zoning Ordinance, be and the same is hereby amended as follows: SECTION 1. That Article V, Section 153(5) be deleted in its entirety and substitute in lieu thereof the following: (5) Side yard setback for zero lot line units must be from zero (0) to one and one-half (1 1/2) feet or a minimum of ten (10) feet from the adjacent property line if buildings are to be separated over a tenth of a foot. The eave overhang is the only permitted element of the building structure allowed in the one and one-half (1 1/2) foot setback. The opposite side yard must be at least ten (10) feet and must be kept perpetually free of permanent obstructions (such as accessory buildings). SECTION 2. That Article V, Section 163(6) be deleted in its entirety and substitute in lieu thereof the following: (6) Side yard setback for zero lot units must be from zero (0) to one and one-half (1 1/2) feet, or a minimum of ten (10) feet from the adjacent property line if buildings are to be separated over a tenth of a foot. The eave overhang is the only permitted element of the building structure allowed in the one and one-half (1 1/2) feet setback. The opposite side yard must be at least ten (10) feet and must be kept perpetually free of permanent obstructions (such as accessory buildings). SECTION 3. BE IT FURTHER ORDAINED that this Ordinance shall take effect two weeks from and after its passage as required by law.
